1. Your Subscription

Your subscription will be fulfilled by Fountain Analytics, a division of BF Rio Holdings, a Delaware corporation whose principal place of business is at 1660 International Drive, Suite 225, McLean, VA 22102. By placing an order you represent and warrant to us that you are the subject of the PX Report. If placing your order on-line when you click “Submit Order” you will receive an email acknowledging that your order has been received successfully and is being processed. Your subscription is finalized once we send you confirmation of your order with your subscription account number and payment has been processed. You will receive this confirmation by email within 72 hours. We will not be responsible if you fail to receive the written confirmation because you have supplied us with an incorrect email address. We reserve the right not to accept or process your order for any reason. All orders are subject to validation checks and authorization by your credit card issuer. If we do not accept your order and your credit card has already been debited, we will notify you and refund your card in full immediately.

2. Subscription Term

The annual subscription entitles you to four (4) quarterly PX Reports.

3. Delivery

The first PX Report will be sent to you for the most recently completed quarter. Thereafter you will receive your quarterly PX Report within seven (7) days of the quarter end. We will deliver the PX Reports to the email address you provide us when you place your orders. You agree that we will not be responsible for failure to deliver the PX Reports if you have supplied us with an incorrect email address. We will also not be liable to you for any delay in delivery or non-delivery of PX Reports where the issuer of your credit card refuses to authorize payment to us.

4. The PX Reports

You acknowledge and agree that the PX Score and Reports aggregate and constitute publicly available information and that we neither control nor guarantee the accuracy, integrity or quality of the PX Reports.

5. Customer Support

6. Cancellations and Refunds

The minimum term is 12 months as advertised on the website. Cancellations are not permitted until the end of the initial period and we will not issue you a refund. Your subscription will automatically renew after the initial period for successive 12-month periods unless you terminate your subscription by providing written notice to us at [email protected] 30 days prior to the applicable anniversary date of the start of your subscription. In the event of any renewal under this Section 6, Our then-current fees and policies shall apply but in no event shall the increase be greater than twenty percent (20%) of the applicable fee year over year.

7. Prices

Prices displayed on the subscriptions section of the website will prevail at all times in relation to orders placed online. Prices quoted on screen include set up fees. Taxes will be calculated and charged to the subscriber (where applicable). You make a single payment for a one or two year subscription. If you are not using your own credit card to pay for the subscription, you must ask the permission of the credit card holder before entering the payment details. By clicking “Submit” you are confirming that you have obtained the express prior permission of the credit card holder.

8. Personal Information

We use the personal and transactional information (e.g. name, address, NPI number, e-mail address, credit card details) (“Personal Information”) you supply to us in order to fulfil your subscription order. On the online order form we may ask you about receiving details of our products and services and/or those of third parties which may be of interest to you. You should check the relevant boxes to indicate whether or not you wish to receive such information. You will have the opportunity to opt-out of receiving this information at any time. Unless we have been fraudulent or negligent, we will not be liable to you for any losses you may suffer as a result of unauthorized access by a third party to the information (including in particular credit card details) you transmit when you place an order. It is your responsibility to ensure the security of your own credit card details to avoid unauthorized use.

9. General

These Terms and Conditions are subject to change. These Terms and Conditions are governed by the laws of the Commonwealth of Virginia without regard to principles of conflict of laws.
